Custella Sdn. Bhd (“Custella”/“we”/“us”/“our”) owns and operates the website located at https://www.fieldex.com/  (the “Website”), and any subdomains used in connection with or related to the same, and the FieldEx mobile application (the “App”), (together, the “Service(s)”).  

Custella Sdn. Bhd is committed to protecting the personal information that we collect, use, and disclose in the course of providing you with FieldEx’s Service.. This Privacy Policy describes how we collect, store, use and distribute information about identifiable individuals (“Personal Information”) through the Website, App and Service as defined in https://www.fieldex.com/terms-conditions

Our Service is provided to business customers who have registered for an account with us (“Account Owners”) and any information collected via the Website, App, and Service from or about Account Owners’ employees, their own customers (“End Users”), and contractors will be made available to the applicable Account Owner and their authorised Employee Users as defined in our terms of service, https://www.fieldex.com/terms-conditions and will be used by such Account Owner according to their own privacy policy(ies).

Lawful Processing: 

We process your Personal Information as set out in this Privacy Policy and to the extent necessary for the performance of our obligations to you, which may include providing the Service to you under our Terms of Service at https://www.fieldex.com/terms-conditions. We set out below the type of Personal Information that we collect and how we use it. 

Consent:

Except as set forth in this Privacy Policy, your Personal Information will not be used for any other purpose without your consent. We will not actively collect Personal Information for the purpose of sale or third-party marketing in a way that specifically identifies the individual; we do not sell customer lists. You agree that the data collected by the App is essential for us to provide the Service. You may withdraw your consent to our processing of your Personal Information at any time. However, withdrawing consent may result in your inability to continue using the Website, the App, and/or the Service.

Scope

This Privacy Policy covers the activities of Custella in the course of providing the Service and operating the Website and App. It does not apply to the privacy practices of third-parties that we do not own or control, including Account Owners and third-parties that offer products or services to Account Owners linked or made available through our Service. Account Owners are responsible for ensuring that they have obtained the necessary authorizations and consents for any Personal Information they make available to FieldEx for use in accordance with this Privacy Policy. 

In particular, Account Owners represent and warrant to FieldEx that they have the necessary rights under applicable law or have obtained the necessary consents from each End User whose Personal Information is provided by that Account Owner to FieldEx in order to allow FieldEx to use, disclose, and otherwise process such Personal Information as  described in this Privacy Policy.

1. WHAT TYPES OF INFORMATION WE COLLECT

1.1 When You Visit Our Website(s) & Use the App

  • You are free to explore our website(s), landing pages, and microsites related to us without providing any personal information about yourself. 
  • When you visit the website(s), landing pages, and microsites related to us and register for the use of the App or try to download any relevant content as per your need, we may request that you provide Personal Information about yourself. We do this to improve the services we offer you and improve our marketing, analytics, and site functionality.
  • Provided you give us your consent, we may send you emails about our product, new products, and other updates.

1.2 Personal Information

  • This refers to any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, email address, company name, address, phone number, and other information about yourself or your business. Personal information can also include information about any transactions, both free and paid, that you enter on the website(s), and information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter and Google, or publicly available information that we acquire from service providers.
  • Personal information also includes Navigational Information or Payment Information where such information can directly or indirectly identify an individual. Navigational information refers to information about your computer and your visits to this website such as your IP address, geographical location, browser type, referral source, length of visit, and pages viewed. Please see the "Navigation Information" section below. We do not however collect Sensitive Information from you.


1.3 Log Files

  • When you view the content provided by us, we automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times, and referring website addresses. This information is used by Custella to provide general statistics regarding use of our website(s) or related sites. For these purposes, we do link this automatically-collected data to personal information such as name, email address, address, and phone number.


1.4 Information we collect from third parties

  • From time to time, we may receive personal information about you from third party sources including partners with whom we offer co-branded services or engage in joint marketing activities, and publicly available sources such as social media websites.

 

 2. HOW WE USE THE INFORMATION WE COLLECT

2.1 Compliance with Our Privacy Policy

  • We use the information we collect in compliance with this Privacy Policy. Customers of FieldEx are obligated through the End User Licence Agreement (EULA) to comply with this Privacy Policy. We will never sell your personal information to any third party.

2.2 Use of Personal Information

    • send information or App content to you which we think may be of interest to you by post, email, or other means and send you marketing communications related to our business;
    • promote use of our services to you and share promotional and informational content with you in accordance with your communication preferences;
    • monitor and analyse trends, usage, and activities in connection with the Website, App, and/or Service, including generating aggregated and anonymized statistics and disclosing industry trends to third-parties which are derived from use of the Service but do not include any Personal Information;
    • send information to you regarding changes to our Terms of Service, Privacy Policy, or other legal agreements and product upgrades
    • Understand the usage of the App by functions and features 
  • Our basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you.
  • If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.
  • As of date, we do not share any personal information with our partners and third parties
  • We may disclose your Personal Information to third-parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. Further, we may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to:
  1. satisfy any applicable law, regulation, legal process, or governmental request (including in pursuant to subpoenas, civil investigative demands, or similar processes); 
  2. enforce our contracts or user agreements, including investigation of potential violations hereof; and
  3. detect, prevent, or otherwise address fraud, security, or technical issues. 

The above may include exchanging information with other companies and organisations for fraud protection, spam/malware prevention, and know-your-customer purposes. Notwithstanding the general terms of this policy, the collection, use, and disclosure of Personal Information may be made outside of the terms of this Privacy Policy to the extent provided for in any applicable privacy or other legislation in effect from time to time, or pursuant to court orders (including in respect to depositions, interrogatories, subpoenas, civil investigative demands, and other court or regulatory-mandated discovery processes).

If we plan to use your Personal Information in the future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy.


2.3 Use of Navigational Information

  • We use Navigational Information to operate and improve the Websites. We may also use Navigational Information alone or in combination with personal information to provide you with personalised information. We may also use Navigational Information to ease task scheduling by the Management Users and Admin users by accessing the location data of Users in real-time and to optimise all other navigation related features within the App.

2.4 Customer Testimonials & Comments

  • We post customer testimonials and comments on our website(s), which may contain personal information. We obtain each customer's consent via email prior to posting the customer's name and testimonial.


2.5 Security of your Personal Information

  • We use a variety of security technologies and procedures to help protect your Personal Information from unauthorised access, use or disclosure. We secure the Personal Information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use or disclosure. All Personal Information is protected using appropriate physical, technical and organisational measures.


2.6 Social Media Features

  • Our Websites include Social Media Features, such as the Facebook Like button and Widgets, such as the Share This button or interactive mini-programs that run on our sites. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. 
  • Social Media Features and Widgets are either hosted by a third party or hosted directly on our Websites. This Privacy Policy does not apply to these features.  Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.


2.7 Retention of Personal Information

  • We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required in order to contact you about our products and services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements).
  • When we have no ongoing legitimate business need to process your Personal Information, we securely delete the information or anonymize it or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible. We will delete this information from the servers at an earlier date if you so request, as described in section 4.3 "To Unsubscribe from Our Communications" .
  • If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us or ceased using your Custella account. We retain information derived from cookies and other tracking technologies for a reasonable period from the date such information was created.

 

3. HOW WE SHARE THE INFORMATION WE COLLECT


3.1 Change of Ownership

  • If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by Custella on the Websites and the Subscription Service. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your Personal Information, and choices you may have regarding your Personal Information.


3.2 Compelled Disclosure

  • We reserve the right to use or disclose your Personal Information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.

3.3 Cookies and Similar Technologies

  • Cookies and similar tracking technologies are used by us to track content usage and traffic on the Website and App. A cookie is a text file that is downloaded on your hard disk by a web server when you visit certain websites. Cookies and similar tracking technology help us compile aggregate statistics about usage of the Website and App, such as how many users visit the Website, how long users spend viewing the Website, and what pages are viewed most often. This information is used to improve the content of the Website and App. You can set your browser to notify you when you are sent a cookie. This gives you the chance to decide whether or not to accept it. If you disable cookies, you may not be able to take advantage of all the features of the Website, App, and/or Service. Your IP address is reported by your web browser whenever you visit a page on the Website. This information may be recorded together with your registration information on our databases.


3.4 Advertising

  • Our marketing team utilises display advertising on our website and other sites. We use cookies and Web beacons to collect information about your activities on these advertisements to provide you targeted advertising based on your interests.  If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by writing to us at marketing@fieldex.com. Please note this does not opt you out of receiving generic advertisements.

4. HOW TO ACCESS & CONTROL YOUR PERSONAL DATA

4.1 Reviewing, Correcting and Removing Your Personal Information

    • Object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.
    • If you have given us consent to collect and process your personal information, you may choose to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

4.2 Integration with Google Calendar.

 Information collected with Calendar Data

  • To provide you with the requested services, FieldEx may access and retrieve data from the Google Calendar account registered with FieldEx.
  • Only necessary information required for the functionalities provided by the app is collected.

 How the App uses Your Information:

 Service Provision:

  • The App uses the collected calendar data to enable specific features and functionalities within the application.
  • Your calendar information is processed securely and is not shared with third parties, except as outlined in this statement.

 Authentication:

  • Your Google Calendar account credentials are used for authentication purposes to establish a secure connection.

 Improvement of Services:

  • The App may use anonymized and aggregated data to analyse user behaviour and improve our services.

 Third-Party Providers:

  • The App may use third-party services to facilitate Google Calendar integration. These services adhere to strict privacy and security standards.

Legal Compliance:

  • We may disclose your information in response to legal requests or where required by applicable laws. 

Data Security:

  • We employ industry-standard security measures to protect your data against unauthorised access, disclosure, alteration, or destruction.

 Secure Connection:

  • All communication between the App and Google Calendar is done over secure, encrypted connections (HTTPS).

 Authorization:

  • You have the option to grant or revoke permission for Google Calendar integration through the application settings.

 Data Deletion:

  • You may request the deletion of your calendar data from our servers by contacting  support@help.fieldex.com or by mail to D-12-2, 1st Floor, Block D, Plaza Glomac, Jalan SS7/19, Kelana Jaya, Selangor, 47301, Malaysia.

 4.3 To Unsubscribe from Our Communications

  • You may unsubscribe from our marketing communications by clicking on the "unsubscribe" link located on the bottom of our emails, updating your communication preferences, or by sending an email to marketing@fieldex.com. Customers cannot opt out of receiving transactional or product update emails related to their account with us or for the usage of Custella

5. POLICY UPDATES & CONTACTING US 

Amendment of this Policy. We reserve the right to change this Privacy Policy at any time. If we decide to make any material changes to this Privacy Policy in the future, including how we use your Personal Information, we will send you an email or in-App notification. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you. The date on which the latest update was made is indicated at the top of this document. Your continued use of the Website, App, and/or Service signifies your acceptance of any changes. If you do not agree to any changes after receiving a notice of such changes or otherwise do not agree with this Privacy Policy, you shall stop using the Website, the App, and/or the Service. You should consult this Privacy Policy regularly for any changes.
